In addition, the government has instructed its lawyers to seek costs against us. This is clearly vindictive, and unusual to seek against a public interest organization. It is unusual to grant costs against public interest organizations, but as to whether it happens in appeal cases, we are still looking into. As it is an appeal, if any such costs were to be awarded, they would be minimal. We knew this going into the appeal.

Early next week, we will have a conversation about the wisdom of pursuing the case on the merits without the data.

Until then, remember that in times like this, when there is a full attack on earlier gains, our success may not lie in being victorious, but in continuing to draw the line in the sand, and to speak out where others fear to. For this we can all be very proud.
